57.jpg (436438 bytes)   A leading Conservative councillor criticised for receiving hospitality or gifts 893 times over six years, frequently from property developers seeking planning permission, has resigned after an internal investigation found he breached the authority’s code of conduct.

The Guardian revealed in February the extent of the hospitality lavished on Robert Davis, who was the deputy leader of Westminster city council and until last year the chair of its planning committee, overseeing billions of pounds’ worth of new property developments.

Sir Stephen Lamport, the independent person overseeing the investigation, said Davis’s judgement was found “wanting” and his “acceptance of gifts and hospitality from developers before or after a planning decision may … have placed him in a position in which people might seek to influence him in the performance of his duties.”

The independent anti-corruption organisation says that some individuals and companies seek to corrupt major planning decisions through gifts and hospitality, lobbying key members in “secretive” behind-closed-door meetings and hiring serving councillors with inside knowledge to secure planning consent.

A £200 million-plus development in Liverpool under investigation by the Serious Fraud Office (SFO), with no minutes taken at meetings between the developers, councillors and their officials.

A planning chair at Westminster council was forced to resign over excessive gifts and hospitality worth over £13,000.

A developer giving a series of political donations to the local branches of a political party around the same time in which they were applying for planning permission within the same local area.

Through our research for this report, we identified five
key corruption risks relating to councillors’ involvement in
major planning decisions.

soliciting of an advantage as an inducement for an action
that is illegal, unethical or a breach of trust.1 This is a
criminal offence under the Bribery Act 2010.2 Indicators of
potential bribery include excessive hospitality and curiously
timed political donations. Examples include:
• A £500 million+ development in Tower Hamlets
under investigation by the National Crime Agency
(NCA) over alleged solicitation of bribes for
councillors.
• A planning Chair in Westminster council forced to
resign over excessive gifts and hospitality worth over

the local branches of a political party around the
same time in which they were applying for planning
permission within the same local area.

In Wales, councils do adopt codes of conduct, but they
are required to include the provisions of a national model
code, which is defined by ministers and approved by
the National Assembly for Wales.44 Any alleged breaches
are referred in the first instance to the Public Services Ombudsman for Wales If the ombudsman determines
that there is strong enough evidence of a breach, it
refers the matter either to the local authority’s ethics and
standards committee or to the Adjudication Panel for
Wales.46 Ethics and standards committees have the power
to censure a member or suspend or partially suspend
a member for a period not exceeding six months. The
adjudication panel has the power to disqualify councillors
from office for up to five years.

ANOTHER £10,000 HAIN DONOR GOT ENDORSEMENT

In February last year Peter Hain decided it was of great importance to be photographed presenting Mike Cuddy, Managing Director of Cuddy Group, with the NQA 18001 Award Occupational Health & Safety. As good a thing as it is, does it really merit the presentation by the Welsh Minister, glowing endorsement and photo-op? He was too busy to pay attention to his campaign finances because of his work in Northern Ireland he spins. Yet he had plenty of time for Cuddy Group. NQA 18001 is “awarded” for documenting your company’s approach to occupational health and safety. It is essentially for an office manual written by a junior in human resources.
Presenting the certificate Peter Hain said “With their accolade of awards continuing to grow I’m sure the Cuddy Group can look forward to a successful future.”

He also said thanks to Mike Cuddy for the £10,000 donation to his campaign… which he then forgot to declare.

Planning permission may be refused if the development site poses serious harm that cannot be cleaned up. Even if there is minimal risk of contamination, the planning permission may still require the developer to do some clean up work before proceeding with construction work. Find out more here.
