Dear Mx Wilcox

I refer to the recent FOI request received on 1 March 2023 in relation to the questions asked of NPTC with regards to the Heol y Glyn development. and I also refer to the response from the NPTC planning officer in relation to those questions as discussed by the Town Council in item 15 in the meeting of March 14. Can you please make a formal response to our organisation Glynneath Residents Against Contamination that you, the Glynneath Town Council are satisfied that the Neath Port Talbot Council planning authority have upheld their responsibilities in relation to the questions you asked, namely:

They have provided you with an update on the exposed contamination with which you are satisfied?

They have provided you with details of its categorisation in accordance with the council's most
recent Contaminated Land Strategy with which you are satisfied?

They have provided you with information regarding the toxicological report associated with this with which you are satisfied?

I refer to Mr Richards public question in the same meeting in which he has identified the following legislation that allows the council to further investigate the actions of the local planning authority.

The Local Government (Wales) Measure 2011 gave the power of well-being to community councils enabling a council to “do anything which it considers likely to achieve the promotion or improvement of the economic, social or environmental wellbeing of their area.” This power is important because the range of activities permitted by this power is extensive providing a community or town council with considerable scope for action."

Can you please confirm that you as Town Council have discharged its’ duty of care to the public of Glynneath in relation to this measure and that you are satisfied that the local planning authority have historically followed protocol with regards to contaminated land.
