11/3/23 - data request submitted
20/2/2022 I was visited by PC 5763 Price who asked if I was available to visit Neath Police Station for an interview with the CID in relation to a complaint about an email I had sent. I would like to know the Occurrence number? Who made the complaint? What the basis of the complaint was? Who the CID officer was? Any other information in relation to the complaint made against me? I would also like the footage from PC Price 5763 camera? |

The reply was received on a Saturday
afternoon and according to the SWP website, the data protection
team only worked Monday to Thursday, immediately a red flag went
up and looking at the text of the reply there was clear
paltering going on, my questions were clear and concise. Whoever
made this unsigned reply was clearly trying to avoid providing
the information.
Possible reasons: Since COVID the police data protection personnel will have access to their police DP account on their home computeres, they may even still possibly be working from home. A member of the team has actioned this reply as a favour for whoever made the report hoping to eventually pevent the information being divulged. |

Dear Data Protection team, Thank you for your reply and for taking the time to provide further information, , I am comfortable in the way you are processing this data request but would like to further understand the information you are providing because I found this last email to be confusing as there is no context surrounding the relevant text you have copied & pasted. I would appreciate if you could clarify in the following passage from your email, when it states 'data subject, in this instance please can you clarify who the 'data subject' is? "fundamental rights and legitimate interests of the data subject, a necessary and proportionate measure to:" Can you also clarify in the following text when it states 'others', who the others are? To clarify, the ‘data subject’ in relation to the Data Protection Act 2018 Part 3, Chapter 3 Section 45 subsection 4 “…having regard to the fundamental rights and legitimate interests of the data subject…” is you, David Richards. The ‘others’ in relation to the Data Protection Act 2018 Part 3, Chapter 3 Section 45 subsection 4 (e) “protect the rights and freedoms of others” exemption, in this instance are the police staff - members of the Data Protection team, as previously advised more than one member is involved in the processing of your Subject Access Request (SAR).
